General Terms and Conditions
Terms and Conditions (TCs) for the use of the WikiDog app. These also apply to the WikiDog website.
1. Preamble
These General Terms and Conditions (TCs) apply to the use of the WikiDog app, offered by WikiDog Whisperer GmbH (Rambacher Straße 37, 65193 Wiesbaden). By registering and using the app, you accept these TCs.

2. Applicable provisions
2.1. The WikiDog app is a comprehensive software tool designed to serve dog owners and dog lovers as a daily companion and advisor for all matters related to dogs. It offers content on training, knowledge, play, and fun, as well as many other topics—simple, quick, and informative. WikiDog is continuously growing. The content is presented by our unique character WikiDog and is accompanied by illustrations, animations, videos, and texts specifically developed for the app.
2.2. These terms of use apply to all contractual relationships related to the use of the WikiDog app.
2.3. Deviating terms and conditions of the user shall not apply unless WikiDog has expressly agreed to them in writing.
3. Target audience
The WikiDog app is aimed at all dog owners, future dog owners, dog lovers, and companies that manufacture and/or sell dog accessories and dog food.
4. Registration
4.1. The app can be downloaded from the Apple App Store for free. Some selected content is also available to the user for free. To access all content, the user must subscribe.
4.2. Upon registration, users can access a portion of the content for free. To access all content, a subscription must be taken out. Three subscription models are available: a 1-month subscription, a 6-month subscription, or an annual subscription. If the user initially chooses the free version without a subscription, it is still possible to upgrade later by subscribing.
4.3. Registration is only possible after the user has accepted the validity of these TCs. However, there is no entitlement to registration. By registering, a contractual usage relationship between the user and WikiDog is established.
4.4. To use the WikiDog app, registration is required, during which the user’s email address and a username (e.g., first name + last name or a pseudonym) must be provided. The user must also set a password. Alternatively, users can sign up through third-party providers such as Apple, Facebook, or Google. The usage agreement between the user and WikiDog becomes effective only upon confirmation by email from WikiDog.
4.5. The user can change their password at any time and must always keep it confidential. After registration, the user is given an account containing their stored data.
4.6. The user is obliged to promptly update any changes to their data in their account to ensure that communications or notifications from the WikiDog app are correctly delivered.
4.7. The user account is non-transferable and may only be used by the account holder. Sharing the password or allowing other persons to use the account is not permitted.
5. Terms of payment / in-app purchases
5.1. The WikiDog app offers the option to unlock all app content via a paid subscription. Three subscription models are available, differing only in price and duration.
5.2. Subscriptions can be purchased directly in the app. Billing and management of subscriptions are handled exclusively through the user account of the respective third-party provider from which the app was downloaded (e.g., Apple: App Store). Subscriptions can be canceled in the Apple App Store account settings at the end of the subscription period; otherwise, they will automatically renew for the agreed-upon period. The contract and payment processing are subject to the respective third-party provider’s terms (e.g., Apple).
5.3. Once a user books a paid service, the corresponding amount is charged immediately. The user receives a monthly, annual, or one-time invoice depending on the selected model.
5.4. For in-app purchases, the App Store account will be charged after the subscription is confirmed within the app.
6. Right of withdrawal

Below is the statutory withdrawal notice for consumers (please note that companies as defined by § 14 BGB have no right of withdrawal).
You have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period begins on the day of the contract conclusion and lasts for fourteen days.
To exercise your right of withdrawal, you must clearly notify the store provider that you wish to cancel the contract. You may use the attached withdrawal form, but it is not mandatory. It is sufficient to send your withdrawal notice before the withdrawal period expires to meet the deadline.
Consequences of withdrawal
If you withdraw from the contract, we will refund all payments we have received from you, including delivery costs, immediately and no later than 14 days after receiving your withdrawal notice. The refund will be made using the same payment method used for the original transaction, and you will not incur any fees for this refund.

7. Term & termination
7.1. If the user opts for a paid version, the user contract initially applies for the minimum usage period booked. The contract will then automatically renew for the same period unless it is terminated by either the user or WikiDog at least one day before the current period ends.
7.2. If the purchase was made through an app store, the subscription can be canceled following the instructions in the subscription management of the respective app store.
7.3. WikiDog reserves the right to terminate the user relationship immediately for valid reasons, especially in cases of violation of these TCs or other contractual obligations, misuse, or damage to the app’s reputation. Re-registration is possible only after one year. Whether a new registration is permitted after this period is at WikiDog’s discretion and depends on the severity of the previous violations. There is no legal right to re-registration.
8. User obligations
8.1. The WikiDog app is intended for personal use only and may not be used commercially. Users are only authorized to use the app for private purposes. Commercial use of any content, particularly illustrations and animations, is prohibited.
8.2. Software or other scripts that could impair the app’s functionality or accessibility, or that alter, delete, or overwrite WikiDog’s content, may not be used.
9. Rights of WikiDog
9.1. WikiDog reserves the right to change the design, structure, and functionality of the app at any time without user consent. Content may be altered or removed without prior notice, and new features can be added at any time.
9.2. WikiDog has the right to display advertisements on all pages of the app.
9.3. All content, illustrations, and animations are subject to copyright and may not be copied, distributed, or used commercially.
10. Data storage
10.1. During registration, personal data such as name and email address are collected. This data is used exclusively for providing and improving the app.
10.2. Upon termination of the contract, WikiDog is obligated to return all documents and data carriers provided by the user that are still in WikiDog’s possession and related to the contract. Additionally, all data stored in the app must be deleted, unless there are legal retention obligations or rights.
11. User content
Users cannot upload their own content (e.g., comments, photos). However, users can provide feedback directly within the app, which WikiDog will use to improve and develop the app further.

13. Liability and warranty
13.1. WikiDog Whisperer GmbH is only responsible for providing the app. No liability is assumed for the accuracy and completeness of the content provided within the app.
13.2. Claims for damages are excluded unless the damage was caused intentionally or by gross negligence.
14. Changes to the TCs
WikiDog Whisperer GmbH reserves the right to change these TCs at any time. Users will be informed of changes via email. The amended TCs are considered accepted if the user continues to use the app after the changes take effect.
15. Warranty availability
15.1. The app is provided “as is.” WikiDog Whisperer GmbH does not guarantee the availability and functionality of the app.
15.2. The app’s availability may depend on the user’s technical equipment. To fully use the app and access all content, suitable devices and a reliable internet connection are required.
15.3. WikiDog makes every effort to ensure the app runs smoothly and continuously and to maintain its availability. However, disruptions beyond our control may occur, and WikiDog will work to restore the app’s availability as quickly as possible.
16. General information on alternative dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which the user can find at this address: https://ec.europa.eu/consumers/odr/. WikiDog Whisperer GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Jurisdiction final provisions
17.1. For all disputes arising from or related to the use of the app, the place of jurisdiction is the location of the company.
17.2. If the user is a business, the place of jurisdiction is WikiDog’s registered office. If the user is a consumer, the jurisdiction is the user’s place of residence. Should the user, contrary to their information, have no residence in Germany, move abroad after the conclusion of the contract
17.3. Changes or additions to this contract must be made in text form.
